<p>Everyday I am searching for new ways to help people get out from under huge amounts of negative equity.   Lately it seems to be easier to buy another home first and then default on the old one second.</p>
<p>Depending on what type of loan you have when you purchased the property many people have nothing to worry about.    In California banks have what called <a href="http://www.oneactionrule.com/" target="_blank">California&#8217;s one action rule</a>.  Foreclosure or sue but not both.  And with banks being bombarded with people not making payments they are looking to offload these properties though short sales faster than ever.</p>
<p><strong>Would this benefit you and your family?</strong></p>
<p>Who would be a perfect candidate for this scenario?  Anyone who has <strong>Not</strong> gone delinquent on there current mortgages. Or if you have someone that can help you purchase in there name.  Anyone that has money saved to purchase another property.  You can buy a property with as little as 3.5% down.</p>

<p><strong><a href="http://www.ericbaskett.com/acceptable-hardships/" target="_blank">Whats a good short sale hardship?</a></strong> Divorce  -   Pregnant  -  loss of job   -  out grew the house</p>
<p>Will the bank know what your doing?  Good question &#8230;.maybe..  but if they have no recourse against you then there hands are tied!  short sale vs foreclosure&#8230;What will net them the most money&#8230;that&#8217;s all the bank cares about.  Short sale will get them being the bank a higher return.</p>
<p>We need to sit down and talk about who your lenders are, what type of loans you have&#8230;recourse loans or non-recourse loans.  Its all about making a plan.  I have a <strong>real estate attorney</strong> you can talk with to go over any of your legal questions you may want answered.</p>

The banks are going to just roll over and give them a principle reduction and lower their interest rate to 1% for 40 years.</p>
<p>The  fight for a Loan modifications have taken over people lives.  With that comes <strong>Stress</strong>,<strong> Anger</strong>, and then <strong>Depression</strong>.  Depression after a long hard fought battle with an enemy that could care less about your Problems! Many people are looking for a quick fix or an answer right away but it takes months and months for these answers to come.  And sometimes when the answer comes people can&#8217;t believe what they are hearing.  Your loan modification has been Declined!. Due to insufficient income, Declined because your loan needs to be at least 30 days past due, Declined you make to much money, or Declined because there isn&#8217;t a valid hardship.  every commercial, advertisement has some great program but reality be most people just don&#8217;t qualify.</p>
<p>So let me ask you a question&#8230;.  Is your situation with your house <strong>Personal</strong> or<strong> Business?</strong></p>
<p><strong>Definition </strong></p>
<p>Personal &#8211; you love it and you will do what ever it takes to save it. Work 3 jobs, move in strangers, borrow money from family. You are so wrapped up in saving this property you can&#8217;t see straight.</p>

			<content:encoded><![CDATA[<p></p><div name="googleone_share_1" style="position:relative;z-index:5;float: right; margin-left: 10px;"><g:plusone size="medium" count="" href="http://www.ericbaskett.com/you-are-slowly-running-out-of-time/"></g:plusone></div><p>Something very important is happening on December 31<sup>st</sup> of this year – something that might impact your life, or the lives of your friends, family, colleagues, and clients.</p>
<p>What am I talking about?</p>
<p><strong>The expiration of the <a href="http://www.irs.gov/individuals/article/0,,id=179414,00.html" target="_blank">Mortgage Forgiveness Debt Relief Act</a>.</strong></p>
<p>Oddly enough, many homeowners (including those affected by the Act) are unaware of its existence, or of its ticking clock.</p>
<p>The Mortgage Forgiveness Debt Relief Act applies to <strong>debt relief &#8220;forgiven&#8221; between January 1, 2007 and December 31, 2012</strong>. At this point in time, it does not appear the Act will be extended.</p>
<p>What&#8217;s really at stake? <strong>Money!</strong></p>
<p>Let&#8217;s take a step backwards to put this in perspective.</p>
<p>Debt &#8220;relief&#8221; comes about when a lender &#8220;forgives&#8221; debt owed by a  borrower, as can happen with a short sale, foreclosure, or other type of  loan &#8220;workout&#8221;. Ordinarily, that forgiven amount is taxable. <strong>However, under the Act, the borrower&#8217;s need to pay taxes on the amount of the forgiven debt is eliminated.</strong></p>
<p>Of course, there are caveats that come along with this tax relief.  For example, the debt must be related to a principal residence. In  addition, the total amount of the debt can&#8217;t exceed the borrower&#8217;s  original mortgage loan&#8230; plus the cost of improvements made to the  home.</p>
<p>The implications of this tax relief are huge in dollars and cents! <strong>Take a look at this example</strong>.</p>
<p>In 2007, John Smith bought a home for $250,000 and took out a  mortgage of $225,000. This month John is relocated across the country  for work and must sell his home. His current mortgage balance is  $207,000. Luckily for John, his lender is a bank that is willing to work  with him on a short sale&#8230; and he is lucky enough to find a buyer.  John and his buyer agree to a sales price of $218,000. However, that  amount falls short of what John needs to pay off his mortgage, and pay  closing costs – all of which is estimated to come to $237,620. Since  John does not have enough money to bring to the closing table, John&#8217;s  lender agrees to the short sale, forgiving debt in the amount of  $12,260.</p>
<p>Prior to the Act, John would have been required to declare the  $12,260 as income, and pay taxes on it. Under the current provisions of  the Act, taxes on John&#8217;s $12,260 in relief are forgiven. For individuals  in a 20% tax bracket, that&#8217;s almost $2,500 in tax savings!</p>
<p>And owners of high-end homes – <a href="http://www.huffingtonpost.com/2012/02/28/luxury-home-foreclosures-_n_1306923.html" target="_blank"><strong>defaults of which are on the rise</strong></a> — could be looking at<strong>very substantial tax breaks</strong>, depending on the amount of debt forgiven.</p>
<p>Which brings me to several questions my clients have repeatedly  raised about the Act. I want to share three of those with you here:</p>
<ul>
<li><strong>What is the maximum amount of debt relief under the Act?</strong> Up  to $2 million may be forgiven for married couples ($1 million if single  or if married but filing separately); of course, this must be for a  principal residence. If there is debt forgiven above this amount the  borrower is taxed at ordinary income rates.</li>
<li><strong>Does the Act apply to cars, boats, second homes, investment properties, credit cards, or other debt?</strong> Not  under this provision. Only debt relief for a principal residence  applies under the Act, however, bankruptcy debt relief is non-taxable,  and that is sometimes true for insolvency as well.</li>
<li><strong>Do I have to report the forgiven debt, since I won&#8217;t be paying taxes on it?</strong> Yes! See the IRS and/or your tax professional for additional details.</li>
</ul>
<p>I&#8217;m not suggesting that you race out and tell your clients to hurry  up and default on their mortgage loans so they can take advantage of the  Act. However, it is important that you understand the implications of  the Act and how it may affect your clients.</p>
<p>Encourage them to contact qualified professionals (such as attorneys  or Certified Public Accountants) and suggest they visit the IRS site for  information on the Mortgage Forgiveness Debt Relief Act, which can be  found on <a href="http://www.irs.gov/individuals/article/0,,id=179414,00.html" target="_blank">the IRS’s website</a>. I used information from that site, in addition to <a href="http://www.realtor.org/government_affairs/mortgage_debt_cancellation" target="_blank">information provided by NAR</a> in preparing this Zebra Report for you.</p>

			<content:encoded><![CDATA[<p></p><div name="googleone_share_1" style="position:relative;z-index:5;float: right; margin-left: 10px;"><g:plusone size="medium" count="" href="http://www.ericbaskett.com/freddie-mac-creates-short-sale-timeline/"></g:plusone></div><p>In an effort to make the short sale process more transparent, Freddie Mac (OTC: FMCC) is updating its timelines and also requiring servicers to provide weekly updates when decisions take more than 30 days after the receipt of a complete application for a short sale under the Obama Administration&#8217;s Home Affordable Foreclosure Alternative (HAFA) initiative or Freddie Mac&#8217;s traditional requirements. All decisions must be made within 60-days. The most recent announcement marks the newest part of the Servicing Alignment Initiative (SAI) Freddie Mac and Fannie Mae launched in 2011 at the direction of their regulator, the Federal Housing Finance Agency, to set consistent servicing and delinquency management requirements. Last year Freddie Mac completed 45,623 short sales, a 140 percent increase since the housing crisis began.</p>
<p>Freddie Mac&#8217;s new short sale timelines require servicers to make a decision within 30 days of receiving either 1) an offer on a property under Freddie Mac&#8217;s traditional short sale program or 2) a completed Borrower Response Package (BRP) requesting consideration for a short sale under HAFA or Freddie Mac&#8217;s traditional short sale program. (BRPs are standardized assistance applications developed as part of the Servicing Alignment Initiative.)</p>
<p>If more than 30 days are needed, borrowers must receive weekly status updates and a decision no later than 60 days from the date the complete BRP is received. This will help servicers who may need more time to obtain a broker price opinion or a private mortgage insurer&#8217;s approval on a BRP or property offer.</p>
<p>In the event a servicer makes a counteroffer, the borrower is expected to respond within five business days. The servicer must then respond within 10 business days of receiving the borrower&#8217;s response.</p>
<p>Freddie Mac will use the new timelines to evaluate servicer compliance with the SAI and its own servicing requirements.</p>
<p>Freddie Mac completed 45,623 short sales in 2011, a 140 percent increase since 2009. Overall, Freddie Mac has also helped more than 615,000 distressed borrowers avoid foreclosure since the housing crisis began.</p>

<p>Real estate professionals know that a short sale transaction can take months for it to be approved and closed.</p>
<p>The reality is that short sales usually take three to four times as much as a regular sale to finally get to the closing here in Los Angeles California. From the time the Realtor actually gets the property under contract to the time the lender approves, it could take anywhere from 30 days to six months, depending on how fast the borrower provides critical information for lender and Investor approval.</p>
<p>Even then, you still have one more variable to account for which is the buyer waiting for all this time to get the contract approved by the lender. For this, setting the expectations is a key factor in any short-sale transaction.</p>
<p><strong>Buyers Expectations</p>
<p></strong>Buyers who make an offer on a short-sale property need to know that lenders have to &#8220;reverse underwrite&#8221; a short-sale and make sure that they are allowing the sale to happen close to market value. I say &#8220;reverse underwrite&#8221; because instead of determining affordability, they will look for &#8220;un-affordability.&#8221;</p>
<p>They will check the seller&#8217;s financials to verify that they can&#8217;t afford the house anymore and consequently, they will order a price opinion from a broker or certified appraiser, commonly known as BPO (Broker&#8217;s Price Opinion) to make sure the house is being sold close to market value.  If the offer is too low compared to what is owed, it will make more financial sense to the Lender to just foreclose the property and re-sell it as an REO (Bank-Owned Property). All this will happen while the buyer is still waiting for a response so it is very important to set the expectations correctly from the beginning to avoid losing the buyer close to the end of the process.</p>
<p><strong></p>
<p>Seller&#8217;s Expectations</strong></p>
<p>On the other hand, it is important to also educate the Seller and set the expectations with them from the beginning. They need to understand that the Lender takes its time responding, but when they do, they usually give a 72-hour timeframe to respond or provide the missing documentation. If the documentation is not provided within the specified timeframe, it usually ends up in a closed file and countless work-hours lost. Another common situation that is happening very often is borrowers being served with foreclosure paperwork from either the lender or homeowner&#8217;s association while the short-sale is being processed. It is crucial to let them know that this might happen so that they are prepared for it and receive the documents knowing that they are in the best hands. Foreclosure and short-sale are parallel processes and one does not cancel the other. Sometimes a short-sale might delay a final sale date, but it will definitely not stop the Lender from starting the foreclosure proceedings.</p>
<p><strong>Closing the Short Sale</p>
<p></strong>Short sale success comes from educating not only the seller but also the buyer and everybody else involved in the transaction. Setting the right expectations is the most crucial part of a short sale. Many homeowners who find themselves  upside down on mortgages in the future are likely to consider strategic  default as an acceptable exit strategy.”</p>

<p>Traditionally, the marital  home was the most valuable asset to be divided during a divorce. Couples  would fight about who got to keep the home, or how much each party  would leave with after the property was sold.</p>
<p>The real estate crisis of  2008 left many couples upside down in their mortgages (having negative  equity). Because of that, divorcees now fight about who will be left to  pay off the debt.</p>
<p>Some people believe a short sale would be appropriate.  They don&#8217;t care to pay for a home they no longer live in, and they want  to leave a bad investment behind. Others believe a short sale would be  akin to foreclosure, so they try to keep the house to preserve favorable  credit ratings. By refinancing the property, the party keeping the  house will continue to pay the mortgage, and the party leaving the house  will sever their ties to the property.</p>
<p>Because of the current financial climate, refinancing is  not so easy. The value of the home (or the lack of equity) may present  too difficult a risk to justify a new mortgage. Also, the person trying  to refinance may not have the proper income, or credit blemishes may  present too much risk for a bank to issue another mortgage.</p>
<p>When these issues arise, divorcing parties may benefit  from the new version of the federal government&#8217;s Home Affordable  Refinance Program (also known as HARP 2). This program allows homeowners  to refinance even if they are upside down in their mortgage. Couples  may also agree on a waiting period where spousal maintenance or child  support payments can be documented as income for refinancing purposes.</p>
